ASTRO PRIVACY NOTICE – CUSTOMERS

WHAT IS THIS NOTICE?
Please read this privacy notice (the “Privacy Notice”) carefully to understand ASTRO’s policies and practices regarding the Personal Data of its customers and how ASTRO will treat it. The Personal Data Protection Act 2010 (the “Act”) was introduced to regulate the processing of Personal Data in commercial transactions. The Act, which applies to all companies and firms that are established in Malaysia, requires Us to inform you of your rights in respect of your Personal Data.
WHAT IS PERSONAL DATA?
“Personal Data” refers to information that relates directly or indirectly to you, which can be used to identify you on its own or in combination with other data that We collect or have access to.
WHO ARE WE?
Any reference in this Privacy Notice to “ASTRO”, “We”, and “Us” shall mean Astro Malaysia Holdings Berhad (932533-V) and, as applicable, any of its subsidiaries and related companies as defined in the Companies Act 2016.
WHAT PERSONAL DATA MIGHT WE COLLECT FROM YOU?
The Personal Data that ASTRO may collect about you will vary depending on how you interact and engage with ASTRO. For example, it may include:
your name, date of birth, identification supporting documents (including NRIC or passport number), gender, nationality and race, preferred language, current private and/or business address, installation address, telephone or mobile phone number, email address, questions and/or data to facilitate security measures We have for your account;
your credit and/or debit card information, bank account details and your payment history;
the status of the products and/or services you have acquired from Us or subscribed to;
how you use the products and/or services;
the equipment (such as your set top box and your computer system) and/or software you use when accessing our and/or our preferred merchants’ and strategic partners’ products and/or services;
your personal interests and preferences to help Us tailor offerings of our and/or our preferred merchants’ and strategic partners’ products and/or services which would suit you best;
clickstream data when you visit any of ASTRO’s apps, social media platforms or websites;
recording of calls placed by you to our help desk for our service enhancement and improvement; and
such other information that may be necessary for ASTRO’s legitimate business purposes or as required by applicable legal requirements.
WHAT ARE THE SOURCES OF YOUR PERSONAL DATA?:
We may obtain Personal Data from you directly when you:
communicate with Us, including when you submit an application to become our customer or when you contact Us regarding any enquiries;
subscribe for specific ASTRO product and/or services;
use any ASTRO products and/or services;
enter or participate in any competitions, contests or loyalty programmes run and/or organised by or on behalf of ASTRO;
request any information or register any interest in any of ASTRO’s products and/or services;
respond to any marketing or promotional materials circulated by ASTRO;
visit any ASTRO offices, premises, or retail centres;
visit, browse, post on or input any information into any ASTRO apps, social media platforms and/or websites;
lodge a complaint with ASTRO; and
provide any feedback to ASTRO.
Other than Personal Data obtained from you, We may also obtain your Personal Data from third parties We deal with or are connected with you (including credit reference or reporting agencies or financial institutions) and from other sources where you have given your consent for the disclosure of Personal Data relating to you, and/or where otherwise lawfully permitted.
We collect information about your use of our websites from cookies. Cookies are packets of information stored in your computer or device which assist your website navigation by customising site information tailored to your needs. Cookies in themselves do not identify the individual user, just the computer or device used. You are not obliged to accept cookies. If you are concerned, you can set your computer or device either to accept all cookies, to notify you when a cookie is issued, or not to receive cookies at any time. However, rejection of cookies may affect your use of our websites as We will be unable to personalize aspects of your use of the website.
Please be informed that this Privacy Notice applies solely to ASTRO’s websites and does not apply to any third party websites you may access from our websites. To determine how they deal with your Personal Data, you should ensure that you read their respective privacy policies. If you use or subscribe to any product and/or service from any third party and you subsequently provide your Personal Data directly to that third party, your Personal Data will be subject to that third party’s privacy notice.
HOW MIGHT WE USE YOUR PERSONAL DATA? We may use and process your Personal Data for any of the following purposes (together the “Purposes”):
to assess and process your request for ASTRO products and/or services;
to establish your identity and background;
to assess your application to register for the use of ASTRO apps, social media platforms and websites;
to assess your application for subscription to ASTRO products and/or services;
to communicate with you;
to provide any products and/or services to you;
to process your payment transactions;
to respond to your enquiries;
to administer your participation in contests;
to conduct internal activities;
to conduct internal investigations, compliance, audit or security purposes including, without limitation, crime detection, prevention and prosecution;
to conduct market surveys and trend analysis;
to provide you with information on ASTRO’s products and services;
to provide you with information on products and services of our preferred merchants and strategic partners;
for other legitimate business activities of ASTRO;
for such other purposes as set out in the terms of use for each of ASTRO’s websites; and/or
if relevant, such other purposes as set out in ASTRO’s General Terms and Conditions and, if applicable, ASTRO’s Campaign Terms and Conditions.
By providing the Personal Data, you are deemed to have given your consent to the processing and use by ASTRO of the Personal Data for the Purposes.
WHO DO WE SHARE YOUR PERSONAL DATA WITH?
We may disclose your Personal Data to third party companies, organisations, and/or service providers to: (i) carry out services on our behalf which is ancillary and/or required for purposes of providing our and/or our preferred merchants’ and strategic partners’ products and/or services to you; or (ii) help Us provide services to you and to personalize our service and make it work better; or (iii) process payment transactions; or (iv) carry out fraud and credit checks, and collect debts and protect our rights and defend Us and our property; or (v) analyse and improve the information We hold (including about your interactions with services provided by us and/or preferred merchants and strategic partners); or (vi) run surveys; or (vii) carry out any of the purposes as set out in this Privacy Notice.
We may also disclose your Personal Data to various government bodies and agencies to meet our legal and regulatory obligations and to law enforcement agencies for the purpose of preventing and/or detecting crime, or for the purpose of investigations and/or the apprehension or prosecution of offenders and/or protection of national security and/or any purpose that is required or authorized by or under any law or by any order or judgment of a court.
If required for any of the Purposes, your Personal Data may be transferred to locations outside Malaysia or disclosed to any of ASTRO’s licensees, business partners and/or service providers, who may be located within or outside Malaysia. Save for the foregoing, your Personal Data will not be knowingly transferred to any place outside Malaysia or be knowingly disclosed to any third party.
WHAT MEASURES DO WE TAKE TO PROTECT YOUR PERSONAL DATA?
We take these measures to protect your Personal Data by ensuring that:
your Personal Data is kept as required by the Act;
ASTRO’s staff do not misuse your Personal Data; and
any appointed suppliers and service providers who process any of your Personal Data perform in accordance with the terms of their contract with ASTRO. Nevertheless, you are required to ensure the security of your password and not to disclose it to another party to reduce the risk of data breaches.
HOW LONG DO WE KEEP YOUR INFORMATION FOR?
We will maintain your Personal Data in our business records while you remain a subscriber, customer or user of any of our products and/or services or a user of the ASTRO websites. We will also maintain your Personal Data for a period of time after you are no longer a subscriber, customer or user of any of our products and/or services or a user of the ASTRO websites if the Personal Data remains necessary for the Purposes.
WHAT COMMITMENTS DO YOU GIVE IN RESPECT OF YOUR PERSONAL DATA?
You are responsible for providing accurate and complete information to us about yourself and any other person whose Personal Data you provide us and for updating this Personal Data as and when it becomes incorrect or out of date.
If you are under the age of 18, you are required to ensure that your parents or legal guardian consent on your behalf to the processing of your Personal Data as described in this Privacy Notice.
You represent and warrant that the consent of those third parties (including family members, beneficiaries and emergency contacts) whose Personal Data you provide ASTRO with has been obtained to allow Us to process the same in relation to the Purposes.
WHAT ARE YOUR RIGHTS IN RESPECT OF YOUR PERSONAL DATA?
In most instances, it is necessary for Us to process your Personal Data in order to provide ASTRO’s products and services and for ASTRO to operate in the ordinary course of business. However, you may limit the processing of your Personal Data in the manner described in the paragraphs below.
You may at any time contact ASTRO’s Personal Data Protection Officer via registered post or email as set out in Section 13 below to make enquiries or raise complaints about the processing of your Personal Data and you may request in writing to (i) access your Personal Data, (ii) withdraw your consent from ASTRO processing your Personal Data, (iii) limit the processing by ASTRO of your Personal Data and/or (iv) request the correction (including the deletion) of your Personal Data, where you are of the opinion that such Personal Data held by Us is inaccurate, incomplete, misleading or, where relevant, not up-to-date.
In relation to direct marketing, you may request by written notice by registered post or email that We do not process your Personal Data for any of the following purposes: (i) advertising or marketing via phone relating to any product or service of ASTRO or our preferred merchants and strategic partners; (ii) sending to you via post any advertising or marketing material relating to any product or service of ASTRO or our preferred merchants and strategic partners; (iii) sending to you via email or SMS any advertising or marketing material relating to any product or service of ASTRO or our preferred merchants and strategic partners, or (iv) communicating to you by whatever means any advertising or marketing material of ASTRO or our preferred merchants and strategic partners.
Please note that we reserve our right to decline any data access request or data correction request in certain situations, including (i) where we are unable to confirm your identity or (ii) where information requested for is of a confidential nature or (iii) if we receive repeated requests from you and the burden or expense of providing access is disproportionate to the risks of your privacy. We also reserve the right to charge a fee (where permitted under the applicable law) for any data access request.
UPDATES TO THIS PRIVACY NOTICE:
This Privacy Notice may be amended by Us at any time from time to time. Any amendment to this Privacy Notice shall be published on ASTRO’s websites or by other means as We deem fit. Your continued use of any ASTRO products and/or services and disclosure of Personal Data under Section 5 shall be deemed to be your agreement to the said amendment of this Privacy Notice.

If you wish to request to opt out of targeted advertising, or sharing of your personal information, access or correction of your personal information, you may contact ASTRO Contact Centre or you can visit the nearest ASTRO CENTRE. Any request of access to correct personal information may be subjected to a fee and also to applicable provisions in the PDPA. However,were serve the right to decline to process requests which jeopardize the security and privacy of the personal information of others as well as requests which are impractical or not made in good faith.
